THOMAS HULBERTíS WILL MADE 07 JANUARY 1814
This is the last Will and testament of me Thomas Hulbert of Chippenham in the County of Wilts Victualler I give and bequeath unto Robert Humphrys of the Ivy house in the parish of Chippenham aforesaid Esquire and Anthony Guy of Chippenham aforesaid Gentleman all and every my Goods Chattels Rights Credits Stock in Trade monies and Securities for money personal and Testamentary Estate and Effects whatsoever & wheresoever upon trust thereof in the first place to pay and discharge all and every my Just Debts & funeral and testamentary Expenses and from and immediately after payment thereof upon trust to sell call in and convert into money all my said Estate and Effects and place the same at Interest upon real Good account or some other good and sufficient security or securities and alter and change such security or securities as often as they shall think proper and In trust to pay the Interest or dividends thereof as often as the same shall be recovered unto my dear wife Mary Hulbert or otherwise authorize her to recover the same for and during the rest of her natural life for the purpose of enabling her to maintain and grow up my six Children Mary Ann Richard Maria Louisa and Thomas Hulbert and any other Child or Children with which she my said wife is now or shall at the time of my death be inscient and from and immediately after the decease of my said wife then upon trust to pay and divide the whole of the principal monies arising by or from my said Estate and Effects unto my said six Children and such other Child or Children with which my said wife is or shall be inscient as aforesaid in and by equal parts shares & proportions share and share alike and my will is that in case any or other of my Children shall happen to die in the life time of my said wife without leaving issue of his her or their body or bodies lawfully begotten living at the time of his her or their death or respective deaths thereafter the share or shares of him her or them so dying shall go to and be equally divided amongst the survivors or survivor of my Children and the issue of such of them as shall be then dead but such issue are to take no greater share altogether than his her or their parent or respective parents would severally have taken if living provided and I do hereby empower my said trustees and the survivor of them as Executors and advisors to permit and suffer my said wife to continue the business in the house where I now live or to take any other house and follow any other business which she and my said trustees shall deem advantageous or expedient and to have the use of my said monies and Effects during her life the better to enable her to grow up her family but it is my will that the said business shall be at all times subject to the superintendance and inspection of my said trustees who are to sell and dispose of my Effects whenever they shall think proper and I do also empower my trustees or trustee for the time being during the life of my said wife to advance any part of the share of other of my Children for or towards his or her apprenticeship or for his or her advancement in life and do constitute and appoint the said Robert Humphrys and Anthony Guy Executors in trust of this my last will and I do direct that neither of them shall be answerable for the act receipt neglect or default of the other and that they shall by and out of my said Estate and Effects deduct and reimburse themselves all such Costs Charges and Expenses as they shall severally pay or sustain in or about the execution of this my will or the trusts hereby in them reposed in witness whereof I the said Thomas Hulbert have to this my last will & testament set my hand and seal the seventh day of January one thousand eight hundred and fourteen the mark and seal of χ Thomas Hulbert ς signed sealed published and declared by the said Thomas Hulbert the Testator as and for his last will and Testament in the presence of us who at his request in his presence and in the presence of each other have subscribed our names as witnesses thereto. Proved at London 18th august 1817 before the judge by the Oaths of Robert Humphreys and Anthony Guy Esquires the Executors to whom admon was granted having been first sworn by comon duly to admr.//.
